Attached is the decision received from Judge McMahon on BSOR's motion with respect to gypsum. She has ruled that it is OK for BSOR to accept trucks containing gypsum from Lafarge, deposit the gypsum on the floor of the building, and transfer it into rail cars for shipment. She has ruled that it is not OK for BSOR to move containers of waste gypsum onto the site for transfer onto rail cars. Her decision is based on the conclusion that the latter operation involves solid waste, while the former operation does not.
