A Regular Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY was held on Tuesday, June 1, 1999 at the Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520.

The following officials were present:

        Mayor Elliott called the meeting to order at 8:00 p.m.  Everyone joined in the  Pledge of Allegiance.


Trustee Grant made a motion to approve the minutes of the Regular Board Meeting held on May 3, 1998 as corrected.  Trustee Daubney seconded the motion.  The Board voted for unanimous approval.

Trustee Daubney made a motion to approve the minutes of the Regular Board Meeting held on May 17, 1999 as corrected.  Trustee McCarthy seconded the motion; unanimous approval.


Trustee Grant made a motion to approve the vouchers as follows, subject to review by the Audit Committee.  The motion was seconded by Trustee Daubney and approved unanimously.

Village Manager Herbek read the following correspondence (full text available at the Village Office):
        a.      A letter from the NYS Dept. of Environmental Conservation regarding a Notice of Complete Application that has been submitted.  Village Manager Herbek explained that this has been prepared by the Waterfront Advisory Committee to correct tidal erosion at Senasqua Park.      Village Manager Herbek added that this was put on the agenda as a point of information that they are going through the process; the cost will not be known until the project goes to bid.  Trustee Grant stated that she had some concern about the visibility of the wall using the suggested process.  Village Manager Herbek replied that he could ask if there are other appropriate alternatives.
A letter from Denise Weale, 103 Hastings Avenue, requesting permission to close Hastings Avenue, between Oneida Avenue and Benedict Blvd. on Sunday, July 4, 1999, between the hours of 10 AM and 8 PM for a block party.  Trustee Daubney made a motion to approve the request; seconded by Trustee McCarthy; unanimous approval.
A letter from William K. Broudy and Janet Nelson, Finney Farm residents, regarding replacement or upgrading of their neighborhood water system.  Mayor Elliott stated that all had agreed to wait until the approval process was finished with Hudson National; he has met with members of the golf course’s law firm and the principal of the golf course and he will arrange another mutual meeting.  Mayor Elliott added that he is waiting for the return of Hudson National’s Attorney Linda Whitehead.  Mr. Broudy and Ms. Nelson agreed to be the representatives for Finney Farm residents.  Gene Perl agreed that Mr. Broudy and Ms. Nelson represent, almost  unanimously, the feelings of Finney Farm residents.  Monica Sabia stated that a number of young families reside on Finney Farm and the quality of the water is a day-to-day issue.  Janet Nelson added that the people on Finney Farm are not so desperate that they will agree to anything thrown at them; that they want Hudson National to make a statement about how they perceive this issue.  Mr. Sapir asked if ownership of the road would be part of the discussion.  Mayor Elliott replied that in his opinion, this should be a two-part discussion.  Trustee McCarthy suggested that it would be helpful for the Board of Trustees to meet with residents of Finney Farm to assure all issues are addressed and this should be put on a work session.  Trustee Grant added that she suspects, and Linda Whitehead has indicated, that Hudson National does not want to be responsible for an antiquated water system and she has some level of comfort that all parties want this issue resolved.
A letter from Rosemarie Noonan, Housing Action Council, regarding a request for support of the CDBG program for its Home Ownership Center.  Village Manager Herbek has responded with Village support for the program.
A letter from Douglas G. Wehrle, 84 Old Post Rd. S., regarding the CDBG application for sidewalk improvements on Cleveland Drive and asking that the sidewalk north of Veterans’ Corners should be included in the grant request.  Village Manager Herbek replied to Mr. Wehrle, giving the reasons he believes the area specified would qualify as a CDBG project, whereby Cleveland Drive, which Mr. Wehrle refers to, would not qualify.  Discussion continued on other options, such as painting the curbing and it was decided to put this issue on a work session agenda.
A letter from Martin Smolin, Saw Mill River Audubon Society, requesting a directional sign be put at the corner of Arrowcrest Rd and Rt. 9A pointing the way to the Brinton Brook Sanctuary.  Village Manager Herbek gave the background of previous concerns about the Arboretum directional sign currently in place on the corner of Old Post Road N., adding that Dan Salzberg requested this about six months ago, prior to other directional sign requests.  Village Manager Herbek stated that the sign could be taken down if the Board wishes.  Mayor Elliott suggested that Mr. Smolin’s request be referred to the Planning Board, along with the Arboretum sign.  Trustee Grant stated that the current sign is out of context with other signs in the Village, adding that the requests for signs have expanded.  Trustee Grant asked that no more signs be put up until the signage policy is completed.  A compromise was agreed upon, that the Arboretum sign can remain and the members of the Arboretum will be asked to plant some flowers that will grow up the posts.
A letter from Ann Gallelli, Planning Board, regarding a proposal for directional signage requested by the Croton Free Library; graphics were included for the Board’s information.
A letter from Ann Gallelli, Planning Board, giving an update on the plans for the Grand Street Firehouse addition and the new Harmon Firehouse.
A letter from Karen Jescavage-Bernard, requesting a Waiver of Filing Fees for the handicapped-accessible boardwalk trail planned for the Arboretum.  Trustee Grant made a motion to approve this request, seconded by Trustee Daubney, approved unanimously.


John Prettinor, Truesdale Drive, spoke about the recent drowning in the Croton River, stating that this is an extreme example of unrestricted activity that takes place along the Croton River; he described several events that occur each day during the summer and asked how he can find out who is responsible for specific areas along the River and what activities are and are not allowed.  Mayor Elliott replied that this area is a unique situation, with a number of parties responsible for different areas.  Mayor Elliott suggested Mr. Prettinor contact Village Manager Herbek’s office where he can obtain the proper information he is looking for.  Village Manager Herbek stated that during Memorial Day weekend, a number of non-residents were turned away from Silver Lake and simply went downstream; that the recreation area problems have been increasing each year; one suggestion is to have an adult patrol the recreation areas to help the younger persons who are working at the recreation areas for the summer; he will discuss this issue at the next staff meeting.  Mayor Elliott added that a clear policy is needed to protect those that are using the Croton River appropriately from those that are using it inappropriately.  Trustee Daubney added that the Village must not take away the helpful actions such as supervised camping on Fireman’s Island.

The resolution for referral of Local law Introductory #4, 1999 to the Planning Board was withdrawn pending further discussion on splitting this resolution into two parts.

On motion of Trustee Grant, seconded by Trustee Daubney, the following resolution was adopted unanimously by the Board of Trustees of the Village of Croton on Hudson, New York.

WHEREAS, on May 17, 1999, the Board of Trustees awarded a contract to Westchester Fine Grade, Inc., of Mt. Vernon, NY in the amount of $792,147.00, and

WHEREAS, two optional items were included in the bidding process for three revenue collection device enclosures and thirty-nine digital parking meters, and

WHEREAS, the Village Board wishes to include these two optional items as part of the Croton Harmon Parking Facility Phase II project,

NOW THEREFORE BE IT RESOLVED, that the Village Manager is hereby authorized to sign a contract with Westchester Fine Grade of Mt. Vernon, NY, for the two optional items to include three revenue collection device enclosures for the bid price of $5,000 per enclosure for a cost of $15,000.00 and thirty-nine digital parking meters at a cost of $800.00 per meter for a cost of  $31,200.00.


Village Manager Herbek reported that Phase II of the Parking Lot project will begin on June 5, 1999 and will last four to six weeks; it is recommended that citizens utilize car pools, drop-offs and bicycles during the construction period; signs are posted at the train station and flyers will be distributed.

Village Manager Herbek reported that a propane tank explosion occurred on Van Wyck Street today, 2 policemen were knocked to the ground by the blast, but not hurt; ex-Fire Chief Bill Vlad was hit on the leg by a piece of the tank and suffered a compound fracture of the leg; all police, firemen and emergency services did an outstanding job responding to the situation.

Village Manager Herbek introduced Sarah Roberts, who is serving as summer intern.  Village Manager Herbek asked that the Board adjourn after the meeting to executive session.

Village Treasurer Reardon reported that the County of Westchester was reluctant to recommend Coyle Construction, but due to the bidding process, the low bidder prevailed.  Village Manager Herbek stated that this company was discussed at length, but there was no legal way to prove they were not a responsible bidder.   

Trustee McCarthy asked Village Manager Herbek if the Village was going to hire a shuttle bus during the upcoming Parking Lot construction.  Village Manager Herbek replied that this is extremely costly and this work is being done during the summer period when ridership goes down and there should be spaces available.  Trustee McCarthy responded that she does not want to end up in a situation where someone has a permit and finds that they have no place to park; that adequate plans should be made to see that this does not occur.  Mayor Elliott stated that this would have to be worked out.  

Trustee McCarthy added that she was at a ZBA meeting and they have requested a work session to discuss their concerns about people who do construction work on their home without obtaining permits and the subsequent fee structure to address this.

Trustee McCarthy reported she attended the Waterfront Committee meeting where the results of the survey were discussed; designs for the former Seprieo property are on display in the meeting room and will remain for a while.

Trustee McCarthy reported that the Memorial Day ceremony was very moving.

Trustee Daubney reported that open fires have been seen evenings at the waterfront areas and citizens should report these to the Police Department.

Trustee Daubney reported that the Arboretum monitors noted the water level was low this past weekend and also that the Arboretum Board has not received official notification of the appointments of monitors.  Village Manager Herbek responded that the Village needs to get the agreement back from Hudson National; individuals who were appointed will be notified.

Trustee Daubney reported also that the Kiosk Committee will be meeting next week.

Trustee Grant asked if the Village has heard from Metro North regarding the truing.  It was determined that Trustee Grant will draft a letter.  Trustee Grant referred to a memo received from VEB regarding business signs going up prior to  c.o.’s being issued.  Village Manager Herbek responded that Joe and Kary are trying to be diligent about not issuing any c.o.’s where sign issues are still pending. Trustee Grant reported also that the Library cookbooks are ready and are available at the Library for $15.00.

Village Attorney Waldman stated that, regarding the water flow report from the Arboretum, the Village owes it to both sides to transmit the information to the golf course officials and ask for a response.

Mayor Elliott reported that Trustee Grant did the Village proud at the Memorial Day ceremony; he thanked the Central Veterans’ Committee, Andy Mayti, Tom Gariepy and everyone who assisted in the ceremony.

Village Manager Herbek reported also that  Summerfest will kickoff with a parade at 1 PM on Sunday.

Trustee McCarthy made a motion to adjourn to Executive Session to discuss the sale of property.  Trustee Daubney seconded the motion; unanimous approval.

This portion of the meeting was adjourned at 10:15 PM.
