An Executive Session of the Board of Trustees of the Village of Croton-on-Hudson, NY was called at 7:30 p.m. on December 17, 2001 prior to the Regular Meeting of the Board to discuss the Kieran Murray Article 78 proceeding with respect to his lot on Mt. Airy Road. The executive session was continued after the Regular Village Board Meeting at which time Trustee Wiegman moved to approve the following resolution. The motion was seconded by Trustee Harkins with the following vote:

Trustee Wiegman: Aye
Mayor Elliott: Aye
Trustee McCarthy: Abstain
Trustee Grant was absent from the executive session and the regular meeting.
1. That upon closing of title on the sale of the current Murray lot to Franzoso, the Village will withdraw its appeal from Judge West s decision.
2. That the Board authorizes the Village Attorney to distribute his Memorandum dated December 12, 2001 and attachments to counsel for Murray and Franzoso.
3. That the Village Attorney advise counsel for Murray and Franzoso of the potential effect on the existing Franzoso lots of conveying to the current Murray lot a strip of the adjacent Franzoso lot.
4. The Board desires, but does not require, that Franzoso convey such a strip to the Murray lot, consistent with his retention of the construction options that he currently has under the Village s Zoning Law.
