WATER CONTROL COMMISSION MEETING OF FEBRUARY 16, 2000
A meeting of the Water Control Commission of the Village of Croton-on-Hudson, New York, was held on Wednesday, February 16, 2000.

The meeting came to order at 7:30 P.M.
APPROVAL OF MINUTES:
10/30/99 - Due to the absence of Mark Goldfarb at the last meeting the approval of 10/30/99 minutes had been held over until tonight's meeting.
Goldfarb - Made Motion to accept the 10/30/99 minutes as submitted

DISCUSSION:
Proposed Subdivision of the "Velardo" property located at North Riverside Ave., Section 67.19 Block 1 Lot 4.
Andrew B. Fetherston, P.E., representative of the Engineering firm "Ralph Mastromonaco, P.E., P.C.", Consulting Engineers for Mr. Velardo.
Mr. Fetherston submitted revised plans as per the Boards request at the last meeting.
Fetherston - The original plans showed a possible septic area. We have erased that from the plans and that disturbance will no longer take place. It will be located within the 20 ft. buffer zone but not the 100 ft. The Westchester County Health Dept., will not allow a septic within 100 ft. of a stream. The original proposed septic area is no longer shown on the plans. We also added erosion control measures.
Discussion followed over plans.
Fetherston - The primary structure could feasibly be kept out of the 120 ft. area. The number of bedrooms is according to the septic size. This plan does not give a graphic display as to the disturbance. I do not have the field size, but I can get it. The other plans did not show erosion control. Erosion will be minor.
Odland - During the site walk we were concerned about the one lot (Sub. Div. Lot #3). We wanted to find ways to minimize the impact in that area and find ways to level out the edge of the lot.
Discussion followed over plans.
Odland - Is it possible to rotate the house? The current location is not an impossible location, but we would want some preventative measures with respect to erosion control.
Fetherston - We can double the erosion control measures.

Odland - We are also concerned with keeping herbicides under control.
Discussion followed over plans and grading areas.
Garbarini - Will there be a wall in the disturbed areas?
Fetherston - It will be a disturbed area and yes, it is within the 120 ft., and yes there will be grading within the l20 ft.
Sally - It is a relatively flat spot where the house is sitting.
Fetherston - The silt fencing would have to be slightly beyond the area of disturbance and the grading area as well.
Garbarini - Your current plans are not to make it level with the house foundation?
Fetherston - No, I am not.
Garbarini - We were under the impression that you were going to put some type of a wall there.
Odland - What ever it is, it will not have to be very big.
Fetherston - Perhaps a curb would be sufficient.
Goldfarb - Will there be a basement?
Fetherston - I think so. I have not seen the house plans. I assume there are plans for the house.
Garbarini - I think we determined it was a buildable lot, but we thought there should be restrictions put in place for additional silt fencing and hay baling. Perhaps a two-foot wall so no one will start to naturalize into the wooded area.
The Board agreed on the determination that this was a buildable lot.
Garbarini - What trees did the planning Board ask you to preserve and what trees will you be taking down? We (WCC Members) were wondering if you actually need to remove all the trees that you are planning to remove. We were hoping you could preserve some of them. Some of the trees seem to be outside the area and do not need to come down.
Goldfarb - What are you replacing them with?
Odland - Will landscaping go beyond the building envelope?
Fetherston - I do not know. You have indicated that there are a couple of trees that you do not want removed. There is nothing on the plans that indicates the trees are decayed. I will make a note of your request.
Garbarini - The trees we are concerned about are the ones outside the disturbance area.
Discussion followed over plans. It was determined that Mr. Garbarini was referring to the wrong set of plans. The trees do encroach the disturbance area.
Fetherston - The footprint of the house relies on where the septic must be.
Garbarini - The Planning Board is looking for our input. Our general conclusion is that we think it is a buildable lot and when the time comes for you to apply for the building permit we would request that you come before us for a Wetland Activity Permit. The erosion control plans could change by then.
WCC Determination:
The Water Control Commission has determined that this is a buildable lot and requests the applicant come before the Water Control Commission for a hearing when the Building Permit Application is processed. The Board also requests that the Planning Boards Resolution stipulate conditions with respect to erosion control measures.
Fetherston - I would like to state that this will not take two years for us to plan.
Garbarini - You will need to apply for a building permit and then it will come before us again for approval.
Fetherston - We will clearly define a clearing and grading line.

DISCUSSION:
BOAT LAUNCH:
Garbarini - I went to the Waterfront Advisory Council meeting and Richard Herbek walked us through the plans of the Boat Launch. Much to our dismay the ramp is going to be wider. It will be wide enough to back up a car and unload a motor boat or a sailboat, etc.
They do not think the type of material they are planning on using for the launch will ware well with the salt water. I do not recall what the material was.
Motor boats are not allowed to go faster than 5 miles per hour in the area. I am concerned that boats will go there at low tide. I have seen hunters in the area by motor boat. This is my concern. Some of the funding is from the State. Approving access for any motor vehicle is allowing access for motor ways. During the meeting there was no argument in that respect.
Odland - Will there be a restriction of motor vehicles or just speed limits?
Garbarini - I think there will be restrictions of signs in the area. They are hoping to bid the work and start construction this summer.
The next meeting was scheduled for March 15, 2000.
