WATER CONTROL COMMISSION MEETING MINUTES OF JANUARY 17,2001

A meeting of the Zoning Board of Appeals of the Village of Croton-on-Hudson, N.Y. was held on Wednesday, January 17, 2001.

MEMBERS PRESENT:    Sally Odland, Chairman
                            Stuart Greenbaum
                            Mark Goldfarb
                            Charles Kane


The meeting came to order at 7:30 P.M.

APPROVAL OF MINUTES:

Greenbaum - Made Motion to accept the minutes as corrected

Goldfarb - Second the Motion

Vote:  4-0  In Favor


HEARINGS:

No hearings scheduled


DISCUSSIONS:

Removal of Railroad Ties:

Odland - The D.E.C. is consulting with West Point experts and they are trying to coordinate a plan for the removal of the railroad ties.   This is not going to be an easy project.  The Village will need to assess whether it is a good idea to remove these ties or not and what long term impact it will have, if any.  They have been debating on how to remove the ties.   Helicopter and a barge has been suggested.  The idea is to disturb the settlement as little as possible.

Odland - We (WCC) have requested to review plans.


Odland - The topography of the bottom and the channel flow changes every year.    They move all the time.  River channels migrate and with a big storm it can change dramatically.

Odland - There is a 60 day public comment period and I suggest we draft a letter to the Environmental Protection Agency stating the PCB hot spots and our support for dredging.

WCC Member, Charles Kane, agreed to draft the letter with the following issues in mind:


        1.  Migration of River Channels releasing "buried" PCB's to the environment.

               2.  The EPA's plan to dredge should be combined with source control action.

PROPOSED DREDGING OF DUCK POND:
Odland - The Village has agreed to have Ocean & Coastal Consultants start on the plans and we have suggested Cornell in Westchester to analyze the soil.  The Village hoped to start work this winter, but the project is much more expensive than anticipated and funds are not available.  The Village needs to decide when and how to obtain funds for this project.

The Commission suggested a memo be sent to Rick Herbek with the following suggestions and concerns:

1.  The Commission suggested the Village fill the pond with water to allow
     recreational skating at the Duck Pond until the Village is able to afford to
     move forward with the dredging and improvements.

2.  The Commission recommends ("if viable") to remove 6" to 8" of
     sediment from the top until the Village can afford to proceed as planned.  
     The Commission also recommends the soil be tested prior to removal.

3.  It is suggested that there be two sediment sinks at the location of two
     inlets at the Duck Pond.

4.  It is recommended that these tasks be performed by In house
     Consultants/Employees.

KAPLIN'S POND:

Odland -  The pond is getting shallow and will fill in like other wetlands in the area unless the rate of sedimentation can be slowed.

The Commission agreed they would like to see Kaplan's Pond protected and used as a skating pond.

TEMPLE ISREAL/LOUNSBURY RD.:

Odland - Presented the WCC Members a copy of a petition she had received with respect to the anticipated proposed addition to the Temple.  

Odland -  I have gotten in touch with some of the persons listed on the petition and one of the concerns is an old septic system which is approximately 40-50 years old or more.  At the time the Site Plan Approval was given the representatives of the Temple assured us that the number of students (258) would not increase.  The Board of Health's approval was based on no increase in the number of students.

The Commission stated that they were concerned about septic discharge and if the septic was being stretched to its limit.  The Commission suggested having the Village Engineer or Westchester County Health Dept. to inspect the septic.

The Commission agreed to check the Village records with respect to the septic and also request an inspection by the Village Inspector to see if the septic is leaking into the wetlands.

If the Temple has any expansion plans in the future the issue of the septic system must be addressed first and they must come before the WCC.

The WCC stated that if the terms of their current Wetlands Activity Permit have been violated they must come before the Commission again.

Odland - Stated that when the Temple is scheduled to come before the Planning Board the WCC Members should attend the Planning Board Meetings.

BOAT LAUNCH:


Kane -  Do we know the status of the Boat Ramp?  I understand it will consist of gravel and the gravel will be stabilized with stone dust on top.

The Board stated that this was not what was discussed at previous meetings they have attended.  The Board requested to see the plans that were presented at the meeting.
