WATER CONTROL COMMISSION MEETING MINUTES OF JULY 17, 2002

The meeting came to order at 7:30 P.M.



Dominick Mamone, 41 Old Post Road, Section 67.20 Block 2 Lot 20.  RA-5 District.  Request for a Wetlands Activity Permit with respect to a proposed two-car garage.


Mamone - Stated that he was requesting a Wetlands Activity Permit with respect to a proposed two-car garage.  The garage will be 44.25 ft.

Greenbaum -  Our main concern is run-off from the driveway and it discharging into the stream.  This was our main concern with your first application for a two-car garage and I feel a second garage will only compound those same concerns.  The fact that your plans show that more concrete/blacktop will be installed for the driveway only compounds our concerns.  As far as I am concerned, if these issues can be addressed, I am willing to reconsider.

Kane -  (To Mr. Mamone) …Can you address these issues?

Mamone - Originally the property was not usable.  I have restored it considerably.  The driveway is more like a patio.  Cars are not stored in the driveway.  The lawnmowers are stored in the basement.  I have an aluminum boat that I will put in the garage.  Nothing will be stored in the garage.  It will be used only for the storage of my antique cars in the winter.

Greenbaum - (referring to plans) - You had concrete pads and you now plan on blacktopping this area?

Mamone -  I do not like blacktop.  I do not want to change from the gravel that is already there.

Greenbaum -  I am concerned about four cars going up and down a driveway that is within 30 - 20 ft. of a stream.  How can you prevent impact into the stream?

Mamone -  What if I agree to keep gravel there?

Greenbaum -  You previously came before us for a two-car garage, which was granted, and at the time our concerns were the same.  Now you are asking for another garage and we still have concerns with the visual impact, and the impact on the stream.  I do not see the wisdom of going forward with this application, unless you can address our concerns with respect to impact.

Mamone - I have a neighbor, Mr. Phalen, he put up a new garage and no one stopped that.  The cars are parked in front of my house every time they are spray-painting the cars.  The area you are referring to will not be used for cars.

Greenbaum -  How many tenants use the driveway?

Mamone -  Two.  A tenant and me.

Greenbaum -  Why do you need another two-car garage.  If you need it for storage purposes there are storage sheds.

Mamone -  In the wintertime I will be able to just step into the garage from my house.  At the Zoning Board meeting on July 10, 2002, it was determined that I did not need a variance to put the new garage up.  If I put the garage 5 ft. from the property line I can construct a 100 ft. garage as long as it is within the twenty-foot buffer zone from the stream.  I have more than adequate parking in the front of my house for cars.  I only need the garage to store my antique cars. I have no interest in parking my antique cars back there.

Greenbaum -  Will cars or bikes, etc., be stored there?

Mamone -  Both.

Mamone -  I have a neighbor whose car has been parked for six months and it is leaking oil on top of a storm drain.  The car is never moved.

Kane -  What material will be used for the apron?

Mamone -  Gravel and then eventually, if I can afford it, concrete.

Kane -  Do you understand our concern with respect to pollutants going into the stream?

Mamone -  It will not happen.  I just want the garage to store my antique cars and to move them in and out.

Kane -  Would you agree to plantings to prevent pollutants going into the stream?

Mamone - Yes, whatever you recommend.  No way will a car be just sitting there and leaking oil.  

Greenbaum -  You are aware of the complaints that your neighbors had at the first meeting for the first garage; oil, etc., filtering into the ground, visual impact, etc.    My concern is that there will be two impervious surfaces within 35 ft. of a stream.  There will be no way for us to prevent any impact once this is granted.

Mamone - Cars will never be left parked there.  There is enough plat form at the bottom of my property to park 8 cars, if needed, and that area is not near the stream.  

Greenbuam -  I would have no problem if you were requesting a storage shed, but not another two-car garage.  I see no solution to pollutants leaking into the stream.


Discussion followed over plans.


Greenbaum - Any other questions?

Mamone -  If the new driveway area in front of the second garage was gravel would that be OK?

Greenbaum -  Yes.

Mamone -  …or I could use Belgium Blocks.

The Board stated that gravel would be more appropriate.

Discussion followed over plans.

Kane -  Curbing and planting of bushes and plants in that area would help.

The Board agreed.

Greenbaum -  Will the doors on the new garage match the doors on the existing garage?

Mamone -  Yes.  Instead of having a flat building roof it will be a reversed gable.

Greenbaum -  Why have it caddy corner?

Mamone -  That is the reversed gable.

Alberecht -  The slope of the roof might take the drainage into the stream.

Kane -  The system for drainage is alongside the foundation, it is shown on the plans.

Greenbaum -  Any other questions?

There were no other questions.

Greenbaum - Made Motion to Grant the application as requested and with conditions (see attached resolution).

Kane - Second the Motion.

Vote -  3-0   In Favor   Greenbaum, Kane, Albrecht.




Discussion:

Environmental Assessment Form
Galina Feit/Prospect & Old Post Road/ Section 67.20  Block 4 Lot 19.

The Board stated that they were in receipt of the Environmental Assessment Form regarding the Galina Feit property located at Prospect Place and Old Post Road.  The Board agreed to review the form and send their comments to,  Richard Herbek, Village Board, Seymour Waldman, Leo Weigman the WCC Liaison, Seymour Waldman the  Village Atty., Village Engineer and VEB.

                                   RESOLUTION

Dominick Mamone has applied to the Water Control Commission of the Village of Croton-on-Hudson, for approval of a Wetlands Activity Permit respect to a proposed two-car garage.

The property, at 4l Old Post Road North, is located in a RA-5 District and is Designated on the Tax Maps of the Village as Section 67.20 Block 2 Lot 20.

A public hearing having been held after due notice.,

NOW, THEREFORE, BE IT RESOLVED, that the application is GRANTED only to the following extent and upon the following conditions, namely:


l.      Hay bales and silt fencing will be installed a minimum of 20 feet from the
     stream or no more than l0 feet from the edge of the driveway, whichever  
     distance is further from the stream.

2.  Staging of equipment or materials within the prohibited
    buffer zone is not permitted.

3.      Operation of equipment within the prohibited buffer zone is not permitted.
        
4.      Driveway will be graded from point of entrance to adjacent concrete pad trap and surface will be rock bordered by stones comparable to the existing gravel driveway.
        
5.      Road salt will not be applied to the driveway.
        
6.      It is strongly suggested that the applicant take any and all measures necessary to minimize the visual impacts caused by the construction of the driveway, including but not limited to; maintenance and/or installation of appropriate plantings.

7.      No point of the driveway apron shall be situated less than 20 ft.
     distance from any part of the water course as defined in Section 227-3(b)    
     of the Wetlands and Water Courses Ordinance.


Greenbaum - Made Motion to Grant the Amended Application with conditions.
