WATER CONTROL COMMISSION MEETING MINUTES
OF AUGUST 28, 2002

The meeting came to order at 7:30 P.M.
HEARINGS:
Dirk & Kristina Ferguson, 23 Sunset Trail, Section 68.17 Block 2 Lot 39. Located in a RA-25 District. Request for a Wetland Activity Permit with respect to a proposed two-story addition.
Wai Chin - Father and Father In-law of the applicants. - The house is within 120 ft. of the stream. Prior to my daughter living in this house it was used as a rooming house with eight or ten people living there. My daughter has two children and they need extra bedrooms. We have already received a variance form the Zoning Board of Appeals in May and now we need a permit from the Water Control Commission.
Odland - The addition is going to the end of the existing parking, as noted on the plans, and the scale is accurate. During my site visit I noticed the stream was flowing.
Wai Chin - Yes. When there is a heavy rain it flows, but not usually.
Kane - This site visit was after the rain.
Odland - It is an intermittent stream and it was flowing when I was there. Our (WCC) concern is that you keep construction materials and lawn materials away form the stream. We have a prohibited buffer zone and we look for mitigation measures such as silt fencing etc, hay bales, etc., for protection.
Wai Chin - The new construction will extend 16 ft. from the existing house.
Goldfarb - When I visited the site I could not get a sense of how far the new construction would be from the stream.
Two of the Board Members agreed that the new construction would be approximately
40 ft. from the stream
Discussion followed over plans.
Greenbaum - Expressed concern about protecting the stream after the construction has taken place.
Chin - There is very little lawn there and we never put lawn fertilizers down.
Albrecht - How are handling drainage from the roof gutters?
Chin - There are no gutters now. It spills onto the lawn and spills out.
Odland - Will the driveway remain gravel?
Chin - Yes.
Odland - Gravel has better infiltration than a slick surface.
Discussion followed over plans.
Odland - Anyone else like to be heard?
There was no reply.
Hearing Closed.
Odland - Made Motion to grant the application as requested with the following conditions:
The applicant agrees to take mitigation measures such as silt fencing, hay bales, etc., to protect the stream during construction and to protect the stream from erosion and lawn materials such as fertilizers, etc.
Greenbaum - Second the Motion
Vote: 5-0 In Favor - Odland, Greenbaum, Goldfarb, Kane Albrecht
UPDATE DISCUSSIONS:
HUDSON NATIONAL:
Gregg Stanley, Hudson National, has notified the Village and the WCC that they will be reducing the fertilizing due to test results that were high.
KAPLINS POND:
Charles Kane - Rick Herbek, Village Manager, requested that I find two landscape contractors to remove the phragmities. I found two and their bids are in. One bid is over three thousand dollars ($3,000.00) and the other is over eight thousand dollars ($8,000.00). I was informed, by Mr. Herbek that the Village, at this time, can only afford approximately $1,000.00 for this, because they did not include this project in the budget for this year but, perhaps it could be included in next years budget.
Greenbaum - Would he be receptive to a small amount of money being supplied by the Village and maybe we can get volunteers to help with the proper guidance.
The Board agreed to make this recommendation and to discuss it with Richard Herbek/Village Board.
The Board Members discussed liability issues and the type of equipment that will be needed for this project.
Albrecht - How will the phragmities be disposed of once it is removed?
Kane - It will be incinerated and it will be taken to the Peekskill Resource Recovery Plant, not a landfill.
DUCK POND:
The Duck Pond Dredging Project is going out to bid soon and the project will start sometime in the fall.
REQUEST FOR DETERMINATION:

Request for determination if a Wetlands Activity Permit is required for the removal of a drainage pipe.
After Deliberations the Members of the Commission determined that a Wetlands Activity Permit was not required for the removal of the drainage pipe.

Odland - Made Motion to determine that a Wetlands Activity Permit is not required
Kane - Second the Motion
Vote: 5-0 In Favor
ANNOUNCEMENT OF RESIGNATION:
Sally Odland, WCC Chairman, announced her immediate resignation stating new employment and evening classes towards an MBA as her reasons for resigning. Ms. Odland further stated that she is willing to serve as ex-officio to the WCC, if necessary.
The Members of the WCC expressed their sorrow and appreciation for her dedicated and valuable service to the Village and its Community.
APPOINTMENT OF NEW WCC CHAIRMAN:
The appointment of a new chairman will be announced at a later date.
