WATER CONTROL COMMISSION MEETING MINUTES OF
JULY 16, 2003.

The meeting came to order at 7:30 P.M.

DISCUSSION:

John Hackenberg - 7 North Ledge Loop -  Appeared before the WCC Commission for a discussion only with respect to a proposed replacement of an existing deck and determination as to whether the applicant will need to apply for a hearing.

Hackenberg - We built our house in 1973.  The deck has rotted and needs to be replaced.  We will be using the same footprint.  We were also hoping to change it by putting in a screened in porch with roof.  We are in the process of getting designed plans.  When the original deck was built, it was built at an angle to avoid a stream.  The new deck will be rectangular with a rectangle roof.  I am here tonight to see how I would apply for that permit.  Our land is in a wetlands area and rules change quite a bit.  I have a plan that I would like to show you.  It shows the existing house and where the new footing will go.  One problem we have is the expense of getting the architect to draw plans showing where this footing is.  We may be able to save quite a bit of money.
Discussion followed over plans.

Kane - Mr. Hackenberg, called me at work regarding his plans to replace a deck.  I had no plan or survey, so I requested he come before the WCC for discussion.  The applicant would only be installing an additional footing.

Hackenberg -  From the top looking down from the deck the new footing to the closest rock  is 11 ft. or 12 ft.  

Kane - You are within the 120 ft. buffer zone.  Because it is within the twenty-foot buffer zone it will require a hearing.

Greenbaum - The current dimensions from the stream to the outer most portion of the deck are what?

Hackenberg- Twenty feet from the center of the stream.

Greenbaum - What about the footing in relation to the overhang?

Hackenberg - Fourteen or fifteen inches.  The deck is already cantilevered.  We could have an engineer to cantilever it more. There are two, sixteen-inch blocks.

Greenbaum - The issue is whether we have any authority over him not needing a Wetlands Permit.

Kane- The law is explicit that there will be no activity within the 20 ft. buffer zone.

Greenbaum - You should design a deck that would meet your needs and keep the footing outside the prohibited 20 ft. buffer zone.


The board agreed that the applicant would need to apply for a hearing with the Water Control Commission.




Bartelluci/ Storm Water Management Report:


Kane - This report has many recommendations and computerized modeling for storm water management.  We should study this for a while and then the Village Board may ask us for our input.  This is a very detailed report  with lots of cross-referencing and projection of ratification.  The Village Board needs to decide where to take this.

One alternative is to install a pipe from Old Post  Road North through neighboring properties to Riverside Ave that will run through all the properties and this will be paid for by the homeowners.   Bartelucci gave a beautiful presentation explaining all this.  He also gave a slide show and summary of the report.  The whole report is in three volumes.  It is a very comprehensive one.  There are computer images for the sub-basins and numbers for a five and ten year storm and also a fifteen-year storm.

The Water Control Commission Secretary will make copies for the Board Members.

The High Street area has problems concerning neighbors and Mr. DeSantis' property.  There are numerous problems that are interrelated because of the work that the property owners have done.  One property owner bridged a dam so there is no retention above Old Post Road North and it greatly exacerbated the condition and it floods quite a bit.

There is one property that has a group home on it.  They filled the retention pond with dirt so it is now a lawn.  This is what most property owners in the area did to create nice back yards and lawns.  "Bartelluci" recognizes this and he has put a dollar amount on the expense to rebuild and replace these structures.   They came up with a solution that would include money from the property owners to help with the necessary repairs on their property.  They will also check dams above Old Post Road and retention ponds. The problem is the pipe on Prospect Place, it is not the right size and they need to determine what size the pipe is that goes out to the Hudson.  They were not able to locate where this pipe is or the size.  It may be blocked we don't know. There are several lawsuits concerning the property owners. They also studied the grand street area new trunk lines and storm water drains into the Hudson.  There will be lots of work.  We will wait and look at the study.

Greenbaum -  Will they be looking to us for a remediation plan?

Kane  - There will be lots of work.  We will wait and look at the study.  In the summary they have listed associated costs. "Bartelucci " has also recommended that we change our watercourse laws and for us to include a hydrology study and if there is to be any developing or changes there will be a hydrology study.  He has asked that this be placed in our Local Law and he also recommends that applicants obtain a hydrology study.
Greenbaum - It is kind of late for that, there is not much land left for development.
Kane - They also recommended a study of all of the wetlands in the village to be inventoried and studied.


Kane -  Requested that the board study the report.


Kane - It was an excellent report and presentation and many of the residents were present for the meeting.

HUDSON NATIONAL/MANAGEMENT PLAN


Kane - I just received a copy today of the Hudson National Management Plan. I did not have time to address it.  I will hold it over for our September meeting.

CROTON YACHT CLUB    


Kane -  The Croton Yacht Club has request that the village grant permission for them to dredge.  The permission was granted by the Village Board.

They will approach the DEC shortly for their approvals.  I have copies of all the permits they will need and they will need to be reviewed by the DEC and Army Core of Engineers.   

They will also have to come before the Water Control Commission and Waterfront Advisory Committee, because this area is part of the New York State Coastal Zone, and they (Yacht Club) will need to make sure they are consistent with their requirements.   The Waterfront Advisory Committee will mostly be involved in the issuance of this permit.  We need to be concerned about where these sediments will be placed.  The Yacht Club will need to pay to have this fill removed. They expect to pay $80,000 on the dredging.

We should recommend that this culvert be extended out and make recommendations to prevent sediments from accumulating any further.     In the report you will see the culvert. They are going to use a slurry type hydraulic type dredge and they propose to put up a dam like the village has for the duck pond and pump the slurry into the large dam area and to have pipes leading to the Hudson and an overflow so cleaner water will enter the Hudson.  That is the proposal.  What will actually happen, we do not know yet.  There is no plan yet that I am aware of.

WESTCHESTER STREAM MONITORING PROGRAM:

Mary Cane - I completed my course for the Westchester Stream Monitoring Program with the County.  Saturday we went to the Teatown Reservation.  We chose a stream to sample and went one hundred feet for the samples.  We found live insects.  We checked the oxygen levels of the stream to determine if the stream was healthy. We were also given a test kit to test for chlorine and other chemicals.  We took the samples back to the reservation to do the testing.  I asked if there were any streams in Croton that I could test, but the streams in Croton are too small.  We will be doing the testing twice per month on Saturdays

The Board Members congratulated Mary on her completion of the courses.
