VILLAGE OF CROTON-ON-HUDSON, N.Y. WATER CONTROL COMMISSION MEETING MINUTES OF OCTOBER 6, 2004

Meeting came to order at 7:30 p>M.
HEARINGS:
Edward G. Cable, Located at 5-A Warrant Rd. Designated on the Tax Maps of the Village as Section 67.14 Block 2 Lot 1. Request for a Wetlands Activity Permit with respect to a proposed in-ground pool.
The Board acknowledged receipt of a request for adjournment form the applicant.
The Board agreed to adjourn the hearing until the November meeting.

Galina Feit/American Bldg. Technologies. Located at Prospect & Old Post Rd. So. Designated on the Tax Maps of the Village as Section 67.20 Block 4 Lot 19. Request for a Wetlands Activity Permit with respect to proposed Hudson View Sub-Division and Section 227-3-(H) of the Wetlands Ordinance.
Ron Wegner, Cronin Engineering, represented the applicant.
Wegner - We were before the Planning Board and questions arose about poorly drained Raynham soil being on site. We found a small pocket one tenth of an acre that fits the description of Raynham soil. The location is noted on the plans. None of the vegetation fits a poorly drained or wetland area. During a rain there may be small ponding. After rainfall events no soils found after a rain of three feet. It has been confirmed to fit the description of Raynham soil. I did research on soil conservation mapping. Given the relative size of this soil any water that does drain on it quickly drains off. Water does not seem to collect. I mapped out the soils in the buffer zone and the minimum activity setback. Inclusion starts at one half acre and the Raynham falls in one quarter acres. We are requesting a revised wetland activity permit.
Goldfarb - The sole problem is the soil?
Wegner - Yes. It is poorly drained but, it does drain well in this area. We have found no waters in these holes after heavy rains. The soil classification fits, but the classification of poorly drained soil does not.
Rhodes - New holes have been dug?
Wegner - Yes.
O'Connor - The board received a letter regarding the soil testing.
Discussion followed over plans.
O'Connor - The basic control area in the Village Law and other items in the Law is one quarter acre. There was no threshold for poorly drained soils in the Code. This is one tenth of an acre it certainly is not a quarter or half acre. It was on the soil map as Raynham soil that is what brought it to our attention. It is smaller than indicated on the soil maps, but there is some Raynham soil there. The importance of this soil needs to be looked at along with other soils in the control area. That area of the property where the soils are, there appears to be a lot of water that does reach that area during storm events. It tends to seep in the ground in that area.
Rhodes - Where does the water come from?
O'Connor - Old Post Rd. and areas uphill.
Greenbaum - Let's assume you begin to develop this plot, what are the implications of making bad matters worse? Once the construction starts, how will that impact what will occur in this area? Will that increase the potential to create a worse situation?
O'Connor - There will be reduced ponding and infiltration due to grading and vegetation changes.
Greenbaum - I need to ask you about granting a permit based on these findings.
O'Connor - A lot of water flows into these areas and some water seeps into the ground. There is somewhat of a rainfall drainage channel that also reaches that spot. I would like for us to take a look at the area. There is no significant vegetation of value in the control area. I would like to remodel the control area; I would like to see how much the water infiltrates, but there are significant drainage problems in the area down hill from this property. I would like to look at that also.
Greenbaum - Could you look at it by our next meeting date in November?
O'Connor - Yes. We need to diligently make sure we are not open to a possible suit. I have been out during two previous rain falls and there is a fifteen inch pipe and it is too small so water overtops the road. I have seen only a few inches in some locations. Water overtops the road and flows down in this area and flows down into the control area, which acts as a storage mechanism.
Greenbaum - Would the re-constructed proposed channel have an affect on that?
Discussion followed over plans.
O'Connor =- What is proposed is to put drywells in and that will handle it. Putting a curb in is also recommended. It has been under review and looked at carefully. We need to channel the drainage water in order for the development to occur. We need to make some adjustments since developing will be taking water away from the control area and not have it retain and infiltrate the water.
Greenbaum - The Village Engineer says he needs one month to look at the engineering aspects in order to prevent litigation due to any ponding that may occur to downstream neighbors. The Bartilucci plan has been a significant plan to try to mitigate this problem. We will adjourn this hearing to give the engineers time to review the plans.
O'Connor - Having D'Virka & Bartilucci will be a slight additional cost and it has been done fifty-fifty between the village and the applicant. We can propose that to the Village Board.
The Board agreed to adjourn the hearing until the findings are submitted by the Village Engineer and D'Virka & Bartilucci with respect to the drainage issues.
