Meeting came to order at 7:30 P.M.
HEARINGS:
Gene & Monica Mianti, 217 Cleveland Drive, Located in a RA-25 District. Section 68.18 Block 1 Lot 5 & 7. Request for a Wetlands Activity Permit with respect to the proposed construction of an above-ground pool.
Mianti - We are requesting a Wetlands Activity Permit for the construction of an above ground pool.
Rhodes - You have already constructed the fence?
Mianti -Yes a six foot stockade fence.
Mrs. Mianti - There is a gate down the stairs and the elevation is higher in some spots. The fence is here because of the two dogs. You can't get through the hedges and there are two gates. It serves as a barrier.
Greenbaum - So you can't get to the where the pool is?
Mianti - Yes you can.
Greenbaum - There is a requirement that the pool be completely surrounded.
Mianti - There is a slope that goes down.

Rhodes - There is a storm water easement shown on the survey. Did the Village Engineer say it is OK to blockade?
Mianti - Yes. I spoke to the Village Engineer and he said as long as we had a wide enough gate and did not disturb the easement.
Rhodes - There is an area where the overflow goes to the road, is there another drain on the other side of the street?
Mianti - Yes.
Rhodes - They are treating these for mosquito control. I am not sure the Village Engineer is fully aware of this.
Mianti - I did speak with the Village Engineer personally to see where he wanted the gates, etc.
Greenbaum - I am concerned the pool is not completely surrounded with a gate.
Rhodes - How high is the pool?
Mianti - 52 inches.
Rhodes - Thirty three by eighteen and fifty two inches. What is the capacity of the pool?
Goldfarb - How far from the nearest bank is the pool?
Rhodes - Where are your septic fields?
Mianti - About sixty feet.
Rhodes - Have you applied to the Westchester County Health Dept.? Do you have a copy of your septic plan?
Mianti - No. It was installed in 1948.
Rhodes - How long have you owned the home?
Mianti - Since 2003.
Rhodes - When you purchased the home was any testing on your system done?

Mianti - Yes a dye test, because we were not certain on how old it was, and they did maintenance on it.
Rhodes - (To Dan O'Connor, Village Engineer ) Did you get the E-Mail? The stockade fence, is that an issue?
O'Connor - That is an issue that we spoke about. There is a drop off near the road and the Dept. of Public Works will dig up pipe. Westchester County is to put tablets in for mosquito control and the village cleans it out. I will work with Mrs. Mianti with respect to that. We need to get a backhoe to clean the catch basin and there is also a hole that needs to be cleaned out in that area. We will write a letter saying we have access to the right-of-way and request they install a gate fence. The gate would not have a lock on it so the County can have access to drop tablets into the catch basin.
Greenbaum - The second issue is the relationship to the septic.
Rhodes - The septic is over to the left of the house and there is also a home directly across their lot. Number five and seven cannot be sub-divided. This survey ……

Rhodes - If septic is here is there a distribution box? When you had the dye test done did you get a report?
Mianti - Yes, but I did not bring it with me.
Rhodes - But, you have it in your records.
Mianti - Yes.

Greenbaum - Are you concerned about when the pool will be drained? In other words you want to make sure your fields for septic are not in the way of construction.

O'Connor - We can make a condition to the building permit that the contractor will do an exploratory test.
Rhodes - This is an above ground pool and it is 52 inches high with a capacity of approximately twenty thousand gallons.

Stern - Turn to page 12 of the application.
Rhodes - Sorry, it is sixteen thousand eight hundred thirty six gallons.
Greenbaum - It is important not to put the pool on top of septic fields.
O'Connor - Will the contractor be bringing in machines?
Mianti - We will be doing it ourselves. We will make it as level as possible.
O'Connor - It is very flat there. You will have to clear top soil and then sand down.
Mianti - Yes.
Rhodes - So there will not be a birmed earth around the pool?
Mianti - No.
O'Connor - It is just like putting a pool on a lawn.
Mianti - And there will be no deck. We are not thinking of draining the pool once we fill it. We will keep it covered in case of rain run off. We do not want to keep draining it.
Greenbaum - Do we need to have hay bales and silt fencing even though she has a fence.
O'Connor - I would still suggest some silt fencing and hay bales between the fence and the pool.. The filter can have a back wash or not a back wash. You will need a separation tank to make sure that there is no discharge.
Mianti - The one we want does not have any discharge at all.
O'Connor - The WCC could approve it on the condition there will be no discharge filtration system, but a recycle system for the pool and a forty foot silt fence?
Greenbaum - Anyone else like to be heard?

Galina Feit/American Bldg. Technologies Inc. on behalf of the owner Gerald Luss. 100 Truesdale Drive, Section 79.10 Block 1 Lot 9. Request for a Wetlands activity Permit with respect to the proposed construction of a one-family dwelling (Adj. on 5/18/05).
Victor Solarik, Archt. Representing Luss/Follini (new owner) - We were before the Board last month requesting a permit to add a garage and renovations to an existing house and you requested revisions to the plans. We have submitted a revised site plan to you. It is an existing building. The owner is planning to re-build in the same shape and form as the existing structure. The majority of the house was damaged by fire and it needs a new roof and interior repair and utilities. But, beyond that there is very little outside work to be done. What we discussed at the last meeting is that we are proposing to collect as much roof drainage, so it does not go into the river. One of the most important issues we have addressed is a leader on the back side and we will have two leaders that will drag it down to
the lower area. It is hard to imagine putting a drywell in this area. The front half of the building and the side, which actually dumps on the ground, will now be dumped into a drywell and connect to a new leader and there will be drywells and infiltrators in the front.
Rhodes - Did you put any dye to see where this goes?
Cronin - Right to the ground. There was no outlet that we could find.
O'Connor - The new drywell detail or filtration detail, what portion of the roof will that collect?

Cronin - Two thirds of this section (referring to plans) and the front entrance. This section of the high roof dumps on the low roof.

O'Connor - We can't control where the house is, if it were going to be new we would have more control over the location.
Rhodes - It seems to be this whole area where the north and east side is fragile.
O'Connor - The masonry retaining wall and flagstone patio ….

Rhodes - I have a lot of photos, but you can't really see it.
O'Connor - If the walls are in poor condition you can either fix it or take it down and rebuild.

O'Connor - A lot of properties have old retaining walls.
Rhodes - It is not old it is cinder block.

Rhodes - If you are dumping the water into the ground …..it has a lot of fill in the ground.
O'Connor - Where is the fill, you say a lot of fill, where?
Rhodes - Below the patio the drop down there.

Rhodes - I am wondering if water shouldn't just shoot out into the river.

O'Connor - There are a lot of trees that are large in diameter that are Maple trees that should be documented.

O'Connor - As you go from the location of the dry well further north does the ground go flat or up?
Solarik - Slightly up.
O'Connor - Shift this slightly north (referring to plans) so water does not hit the retaining wall then the house water will flow naturally and slowly down hill. This can be a field change once we test for rock to find an exact spot. They will need to come in for a demolition permit. The house is full of soot and they will have to wash soot off the stone with detergent or chemicals and maybe brush it off. That will create more run off. So,

what they will have to do is create a wash water plan and do whatever is needed to pump it in the sanitary sewer system. They will want to clear the house as much as possible before washing. They will also need to see if the outside needs to be washed.
Solarik - The outside is clean the inside is full of soot. Mr. Cronin and I discussed having a collection barrel and pump it from there. The first floor is all wood frame and we want to avoid the dirty water getting into the plywood and structure. For that reason alone we do not want water to go all through the house. We will remove all the dry debris, etc., before it is washed.
Rhodes - Suggested using steam.
Solarik - It could be applied, but eventually it will condense and become water. I have a contractor that deals with a fire restoration company to explore the options.
O'Connor - any type of cleaning method that will create wash water they will need to show how it will be done and prior to any washing occurring and plans must be sent showing the trees and we do not want any bleeding out into the river.
Rhodes - I would like to see some kind of tree outlay. I have about eight photographs. I would be happy to put them on disc and document them for you just in case something happens you will know what was there before.
Solarik - We certainly can locate a large tree nine inches in diameter.
Follini - A neighbor Mrs. Kennedy called me today and she said she did not object to the application.
Rhodes - Nancy said the prior owners of her property had a problem with swimmers that jump off the cliffs and rocks.
Follini - That is not a problem on my property that is her property.
Greenbaum - Anyone else like to be heard?

Greenbaum - Made Motion to grant a Wetlands Activity Permit according to Site Plans/Erosion Control Details dated 4/28/05 and last revised on 6/9/05 and with the following conditions:
1. According to construction notes 1 thru 7 noted on plans.
2. A wash water handling plan for the collection, processing, and discharge into
the sewer system must be submitted to and approved by the Village
Engineer for approval.

Old Business
Re: Lot #4 (Velardo Sub-Division)
Daniel O'Connor, Village Engineer - Informed the Board that the contractors brought in fill with his permission and apparently took it as an open invitation to take fill from other projects.
Rhodes - Do you have the quantity that was brought to the site?
O'Connor - In the process of bringing in the fill they hit two trees and some rock rolled down and landed against other trees. I requested they put up tree protection, no more fill, and to apply for a special permit for the fill. They will need more fill for the driveway. The neighbor extended his garage parking area out a little and actually into the right-of-way. This caused the fill to shift eight feet over more to the south. They will have to revise the plans. This also raises a problem with the driveway, it is shorter and the grade will kick up a little, but I'm not sure how much. There is a new issue with the neighbor who granted the right-of-way. The owner of Lot #2 is building a stone wall taking away the rights to Lot #4, so there are some issues that need to be resolved. By
shifting the fill over they may need to recalculate the steep slopes measurements of the shortened fill. Silt fencing was remarked for buffer from stream channel. I do not believe they are in it, but we need to make certain. It is not a major problem.
Rhodes - Did they finish Lot #3 and the planting plan, etc.?

O'Connnor - The planting plan was done and they did a good job. They cleared the whole area and planted the shrubs, etc. the house has been sold. Lot #2 is on the market. They are about 90% finished.

RESOLUTION
Gene & Monica Mianti, has applied to the Water Control Commission in the Village of Croton-on-Hudson, requesting a Wetlands Activity Permit with respect to the proposed construction of an above-ground pool.
The property located at 217 Cleveland Drive, Located in a RA-25 District and designated on the Tax Maps of the Village As Section 68.18 Block 1 Lot 6 & 7.
A public hearing having been held after due notice.
NOW, THEREFORE, BE IT RESOLVED, that the application is hereby GRANTED as follows:
Goldfarb - Made Motion to Grant a Wetlands Activity with the following conditions:
1. Erosion and Control Measures must be taken such as silt fencing & hay bales.
2. Wash water handling during and after demolition and when washing soot off of stone foundation and walls:
a) Wash water must be collected and pumped into sanitary sewer system.
b) Wash-down plans must be approved by the Village Engineer prior to washing.
3. Right-of-way gate/fence (36" Minimum) must be installed along the front property line in the area of the Village storm drain pipe easement for mosquito control, etc., maintenance.
4. Tests pots must be dug in the pool area and inspected by the Building Dept. to verify the absence of the septic system in the pool area.
5. A 50 ft in length silt fence must be installed down grade between the pool area and stream and in accordance with the New York State Guidelines.
6. The swimming pool filtration system when installed must be the type having no wastewater discharge to the surface of the ground or surface water.
