        Local Law Introductory No. 8 of the year 2004

A local law to amend the supplementary regulations applicable to existing small lots in all RA and RB Districts

Be it enacted by the Board of Trustees of the

Village of Croton-on-Hudson as follows:

Section 1. § 230-40. Supplementary regulations applicable to residence districts, Letter G-Existing small lots in all RA and RB Districts to be amended as follows:

Add new sections 3 (a) and 3(b) to follow after Section 230-40 G (2)

(3) a-A lot meeting the “individually and separately held” requirements of Section (1) and (2) above and therefore governed by Section 230-40 G herein shall continue to be deemed individually and separately held if a) the property becomes commonly owned with an adjoining lot either due to divorce or separation of the parties or by operation of law, i.e. death of a spouse, and b) it is clearly evidenced by objective standards that the intent of the parties was to maintain the lots individually and separately.

(3) b-The date of ownership of such property shall be deemed to be the date of initial ownership of the transferring spouse.  Thus, whenever a transfer is made between spouses pursuant to divorce, separation, or death, and ownership transfers from one separately-holding spouse to another separately-holding spouse the transferee-spouse shall be deemed to have held the property from the date of initial ownership of the transferor-spouse.

Section 2.  This Local Law shall be effective upon filing in the office of the Secretary of State.
