VILLAGE OF CROTON-ON-HUDSON ZONING BOARD OF APPEALS MEETING MINUTES OF NOVEMBER 8, 2006.

The meeting came to order at 8:00 P.M.
APPROVAL OF MINUTES:
10/11/06 & 9/13/06 – Reidy – Made Motion to accept the minutes

Thomas Fallacaro, 3 Arrowcrest Drive. Located in a RA-40 District and is designated on the Tax Maps of the Village as Section 67.15 block 1 Lot 33. Request for a variance from Section 230-40(A)(1)(B) with respect to a retaining wall being built less than five feet from the side property line, and Section 230-40(A)(1)(B) with respect to a retaining wall being built less than five feet from the side property line, and Section 230-40(b) with respect to a retaining wall being built in a front yard, and Section 230-40(A)(1)(a) with respect to a retaining wall being built higher than 15 ft. The Board acknowledged receipt of the applicants request for adjournment.
The Board unanimously agreed to grant adjournment until December 13, 2006 at 8:00 P.M.
Tara Drapala, Tenant of T/C of Croton Inc., 75 So. Riverside Ave. Located in a C-2 District and is designated on the Tax Maps of the Village as Section 78.12 Block 3 Lot 1. Request for a variance with respect to parking.
The Board acknowledged receipt of a letter from the applicant requesting to withdraw the application for a parking variance due to the fact that a previous parking variance had already been granted for a previous business.
The Board also acknowledged receipt of a memo from the Village Engineer with respect to the previous that was granted.
The Board expressed concern that the previous variance request for parking was related to a different type of use (retail business) and the previous variance included spaces for the purpose of displaying equipment. The new application request is for a completely different use as a Day Care Center., which poses many different concerns such as safety when picking up or dropping off the children, having enough room to turn around when exiting the parking lot and the property being adjacent to a busy street.
The Board further acknowledged that the applicant will also need to appear before the Planning Board for Site Plan Approval and the Planning Board will address the safety issues at that time.
The Board further acknowledged receipt of a letter dated November 7, 2006, that was received by the Board on 11/8/06, from Kristen Kelley Wilson, Esq. representing Dona Candido and Edward Bezursik who reside at 1299 Albany Post Rd. and directly abuts the applicants property at 3 Arrowcrest Drive.
