VILLAGE OF CROTON-ON-HUDSON ZONING BOARD OF APPEALS SITE VISIT MEETING CONDUCTED ON MARCH 16, 2007.


MEMBERS PRESENT:  Kathleen Riedy, Chairman
                                        Rhoda Stephens
                                        Ruth Waitkins
                                        Doug Olcott

MEMBERS ABSENT:    Witt Barlow


Meeting came to order at 8:30 A. M.



Thomas Brennan, 45 Truesdale Drive.  Request for consent of the Zoning Board of Appeals with respect to Section 120-8A of the Village Code.  Consent for excavation within 50 feet of a public street or adjoining property line.  No hearing required.

The meeting opened for deliberations and decision only with respect to a public meeting having been conducted on March 14, 2007 and a site visit being held on March 16, 2007.
After conducting a site visit on March 16, 2007 the Board made the following findings:

        1.  There will be no undesirable change to the environment or detriment to nearby
     properties.

        2.  The property of the concerned neighbor Frederick and Betsy Turner of 35
                 Truesdale Drive, is approximately 190 ft. away from the area being excavated
                  and the excavation will have no impact to their property or nearby properties.

        3.  The existing narrow driveway was constructed many years ago and needs to be
                 widened for safe ingress and egress.

        4.  There are a few trees in the area of the proposed excavation that will need to
                 be cut for the excavation to occur.  They are not foundation plantings.  It is
                 recommended by the Board that they be removed for safety reasons.

Riedy – Made Motion to grant consent with respect to Section 12-8A of the Village Code for excavation within 50 ft. of a public street or adjoining property line.

The Board further issues a negative declaration with respect to the Short Environment Assessment Form that was prepared by the Village Engineer on March 8, 2007.

Stephens – Second the Motion
Vote:  4-0 – In Favor – Reidy, Stephens, Waitkins, Olcott.

                                RESOLUTION

                                      “REQUEST FOR CONSENT”
                                        (No Hearing Required)
                                         

Thomas Brennan has applied to the Zoning Board of Appeals of the Village of Croton-on-Hudson, with respect to a “Request for Consent” of the Zoning Board of Appeals with respect to Section 120-8A of the Village Code.  Consent for excavation within 50 ft. of a public street or adjoining property line.

The property, at 45 Truesdale Drive, is located in a RA-9, District and is designated on the Tax Maps of the Village as Section 79.09 Block 6 Lot 37.

A public Site Visit Meeting having been held after due notice, this Board from the application and after viewing the premises and neighborhood concerned, finds:

    1.  There will be no undesirable change to the environment or detriment to
           nearby properties.

    2.  The property of the concerned neighbor to the south of the applicant is
          approximately 190 feet away from the area being excavated and the excavation
          will have no impact to his property or nearby properties.
        
    3.  The existing narrow driveway was constructed many years ago and needs to be
          widened for safe ingress and egress.
        
    4.  There are few trees in the area of the proposed excavation that will need to be cut

NOW, THEREFORE, BE IT RESOLVED, that the Zoning Board of Appeals Grant’s the applicant their consent as follows:


Riedy – Made Motion to grant consent with respect to Section 120-8A of the Village Code.  Consent for excavation within 50 ft. of a Public Street or Adjoining Property Line.
